State control
In accordance with the Law of the Republic of Kazakhstan «On technical regulation», Committee for Technical Regulation and Metrology of Ministry of Industry and New Technologies of the Republic of Kazakhstan is an authorized body, exercising state control for safety of goods on stage of its realization in order to ensure safety of goods, processes for human life and health and environmental protection, including flora and fauna, and also to prevent deception of consumers about safety and quality of goods and processes.
Subjects of state control for compliance with the requirements stated by technical regulations are goods and processes under the application of the technical regulations.
State control for compliance with the requirements stated by technical regulations and normative acts in the sphere of technical regulation and uniformity of measurements is exercised for auditing legal bodies and individuals, including foreign organizations, on the territory of the Republic of Kazakhstan.
Since entering into force on the 13th of May of 2005 of the Law of the Republic of Kazakhstan «On technical regulation» state control is exercised on stage of realization of goods.
In order to implement the provisions of the Law of the Republic of Kazakhstan «On private enterprise» the Committee designed and adopted system of evaluation of risks in the sphere of technical regulation and uniformity of measurements, that was approved by a group of experts (representatives of business community) in Ministry of Economical Development and Trade of the Republic of Kazakhstan and presented to Deputy Prime-Minister of the Republic of Kazakhstan in 2009.
At the present time practical realization of the Committee’s policy in the sphere of state control is exercised by 16 Territorial Departments of Oblasts Committee in Astana and Almaty, in 3 directions:
1. State control for safety of goods produced in Kazakhstan and imported from other countries on stage of realization;
2. State metrological control;
3. State control for compliance with regulations of origin of goods certification.
1. State control for safety and quality of goods produced in Kazakhstan and imported from other countries on stage of realization is exercised in 3 directions:
- selection and purchase of samples of goods for laboratory testing for compliance with technical regulations and normative documents for finances of Republican budget;
- auditing of availability of declaration and certificates of conformity on stage of realization of goods;
- auditing of compliance with requirements of marking of goods in Kazakh and Russian languages (labelling).
2. In accordance with the Law of the Republic of Kazakhstan "On uniformity of measurements " the Committee exercises state metrological control that includes:
1) control for release, condition and application of measuring means, application of measuring methods, standard measuring units, compliance with metrological regulations and norms;
2) control for quantity of goods condemned while trade operations;
3) control for quantity of packed goods while packaging, selling and import.
4) control for licensed production of Symbols of State (emblem, flag) and tangible object with them.
3. Annual state control concerning the Chamber of Commerce and Industry of the Republic of Kazakhstan for compliance with regulations of issuing of origin of goods certificates is regulated by the Law of the Republic of Kazakhstan «On technical regulation».
1) for subjects of trade activity;
2) for subjects, carring out activities in the sphere of state metrological control;
3) for subjects, carring out activities of production and maintenance of measuring means;
4) for subjects, carring out activities of production of Symbols of State of the Republic of Kazakhstan and tangible object with them;
5) for subjects carring out activities of issuing of origin of goods certificates.
