Market surveillance
In accordance with the Law of the Republic of Kazakhstan «On Technical Regulation» the Committee is the authorized body that carries out state control over the safety of products at the stage of its implementation in order to ensure the safety of products, processes for life and human health and the environment, including flora and fauna, as well as prevention activities, misleading consumers about the safety and quality of products, services.
The objects of the state control over compliance with requirements set by technical regulations, are the products, processes, certification bodies and testing laboratories, which are subject to technical regulations.
Currently, the practical implementation of the Committee policy in the field of state control is carried out by territorial Departments of the Committee in 3 areas:
1. State control over security and quality of products produced in Kazakhstan, and imported from other countries at the stage of its implementation;
2. State control over the certification bodies (CAB) and testing laboratories (TL);
3. State metrology control.
1. State control over security and quality of products produced in Kazakhstan, and imported from other countries at the stage of its implementation is carried out in 3 areas:
- selection and purchase of product samples for laboratory testing for the conformity to regulatory documents at the expense of the Republican budget;
- check if there are the declaration and the certificates of conformity at the stage of implementation of products;
- verification of compliance with the requirements for applying the information in the State and Russian languages on the labels of goods (marking).
2. State control over the activity of the certification bodies (CB) and testing laboratories (TL) is carried out only by following the requests of individual persons, legal entities and public bodies reports, including the accreditation body:
- for the conformity requirements of CB and TL for the materials of accreditation and management of quality;
- for the condition of measurement instrumentation used by TL.
- for the compliance with the requirements of rules for products certification by CB.
3. In accordance with the Law of the Republic of Kazakhstan "On ensuring the unity of measurements" Committee implements the state metrology control, which includes:
1) control of the issuance, status and application of measurement instruments, the use of techniques of measurement, standards of units, compliance with metrological rules and norms;
2) control of the quantity of goods, alienated when trading;
3) control of the number of pre-pack products in their packaging, sale and import.
4) control of the licensed activity for the manufacture of state symbols (emblem, flag), and material objects with their image.
State control of compliance with mandatory requirements set by laws and regulations in the field of technical regulations and ensuring the uniformity of measurements carried out on the territory of the Republic of Kazakhstan from the legal entities and individual persons, including foreign organizations.
The authorized state body is the Committee for Technical Regulation and Metrology of the Ministry of Industry and Trade of RK (hereinafter - Committee) and it’s subdivisions in 14 areas, Astana and Almaty.
The goal of the state control is to protect the interests of the state and the rights of consumers on security products for the life and health, the environment.
The objects of the state control over compliance with requirements set by laws and regulations in the field of technical regulation are the products, processes, certification bodies and laboratories.
After enforcing an ordinance of the Law of the Republic of Kazakhstan "On technical regulation" from 13 May 2005 the state control is carried out on the stage of sales of production.
At monitoring the state inspectors are guided by laws and regulations and regulatory documents in the field of technical regulations and ensuring uniformity of measurements:
